Welcome to the divashi.com platform. Please read these Terms and Conditions carefully. The following Terms and Conditions govern your use and access of the Platform (divashi.com) and the use of the Services. By accessing the Platform and/or using the Services, you agree to be bound by these Terms and Conditions.

Access to and use of password protected and/or secure areas of the Platform and/or use of the Services are restricted to Users with accounts only.
In accessing and in using the Platform; You agree of these Terms and Conditions to take responsibility for: (i) your actions; (ii) any charges associated with your use of any of the Services or purchase of Products; and (iii) your acceptance and compliance with these Terms and Conditions.

Any violation of these terms shall result in your immediate disbarment of using our Platform. Should such a case arise, all your ongoing transactions and activities may be temporarily halted or cancelled.

  • General Use of Services and/or Access of Platform
  • Guidelines to the use of Platform and/or Services
    You agree to comply with any and all of the guidelines, notices, operating rules and policies, and instructions pertaining to the use of the Services and/or access to the Platform, as well as any amendments to the aforementioned, issued by us, from time to time. We reserve the right to revise these guidelines, notices, operating rules and policies, and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on the Platform.
  • Restricted activities:
    In connection with using or accessing our Platform and/or Services you agree to comply with our policies, our terms, and all applicable laws, rules, and regulations, and you will not:
    • breach or circumvent any laws, regulations of the Republic of Maldives, or any laws and regulation governing the use of the Platform and/or Services including but not limited to any regulations pertaining to trade within the Maldives.
    • impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
    • use the Platform and/or Services for illegal purposes under the laws of the Republic of Maldives or post, promote, or transmit any prohibited materials under Maldivian law.
    • infringe the copyright, trademark, patent, database, and/or other intellectual property rights (collectively, “Intellectual Property Rights”) that belong to or are licensed to the Platform. Some, but not all, actions that may constitute infringement are reproducing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to the Platform or other users of the Platform;
    • infringe any Intellectual Property Rights that belong to third parties affected by your use of our Services or post content that does not belong to you;
    • If we believe you are violating these Terms and Conditions or any of our policies, or abusing the Platform and/or our Services in any way, we may, in our sole discretion and without limiting other remedies, limit, suspend, or terminate your user account(s) and access to our Services, delay or remove hosted content, remove any special status associated with your account(s), remove, not display, and/or demote listings, reduce or eliminate any discounts, and take technical and/or legal steps to prevent you from using our Services. We may offer a process allowing users to report claimed violations for us to consider and handle through one or more of these options, all in our sole discretion.
    • We may cancel unconfirmed accounts or accounts that have been inactive for a substantial period of time. Additionally, we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion.
  • Privacy Policy:
    Your use of the Services and/or access to the Platform is also subject to the Privacy Policy as set out on the Platform.
  • Listing

This section outlines the rules and guidelines for sellers who wish to list their products or services on our platform. By creating a listing, you agree to comply with the following terms:

  • Product eligibility
    • Products listed must be lawful for sale under applicable laws of Maldives. No items prohibited under the Prohibited Items Act in Maldives shall be listed in the platform. The platform reserves the right to take any actions that we deem fit for such listings.
    • Products listed must adhere to laws and regulations concerning the sale of goods and services under the Consumer Protections Act of Maldives.
  • Listing information
    • Every listing must provide a detailed and accurate description of the product or service. This includes specifying the condition (new, used, refurbished), size, color, material, brand, and any other relevant features. Accurate descriptions help buyers make informed decisions and reduce the likelihood of returns and customer dissatisfaction.
    • Any defects, limitations, or issues with the product or service should be clearly disclosed.
    • The written description should match the visual representation (images or videos) of the product.
    • All costs should be transparently listed, including the item’s price, shipping fees, taxes, and any other applicable charges. There should be no hidden costs that surprise the buyer after they decide to make a purchase.
    • Images used in the listings must be of the actual product being sold.
  • Restricted and Regulated Items
    • Certain items may be subject to additional regulations or restrictions. Sellers must comply with all relevant laws and guidelines for such items.
  • Updating Listings
    • Sellers are responsible for promptly updating their listings to reflect any changes in availability, price, or other relevant information.
  • Enforcement and Penalties
    • Non-compliance with this Listing section may result in penalties, including but not limited to, removal of listings, suspension of account privileges, or termination of the seller account.
  • Acknowledgement of Specific Vendor Policies
    • As a purchaser on Divashi.com it is your responsibility to review and understand the return, exchange, and cancellation policies of individual vendors before completing any transaction on our platform.
    • Please be aware that each vendor on our marketplace may have their own set of policies regarding returns, exchanges, and cancellations, which might differ from those of Divashi.com or other vendors on the platform.
    • By proceeding with a purchase, you acknowledge that you have inquired about and understood the specific policies of the vendor from whom you are purchasing. These policies will govern the terms of your transaction, including but not limited to returns, exchanges, and cancellations.
    • Divashi.com.mv is not responsible for, and shall not be liable for, the individual policies set forth by vendors on our platform. Any disputes related to vendor- specific policies must be resolved directly with the vendor.
    • Your use of our marketplace signifies your understanding of and agreement to this requirement, and your continued use of the marketplace represents your ongoing acceptance of these terms.
  • Payments
  • By using this platform for your transactions, you acknowledge and agree that all payments made through our platform are processed using the payment gateway services provided by Maldives Islamic Bank. Consequently, such transactions are subject to the terms and conditions stipulated by Maldives Islamic Bank’s payment gateway.
  • You are responsible for reading and understanding the terms and conditions of Maldives Islamic Bank’s payment gateway before making any transactions. Your use of the payment gateway for transactions on our marketplace indicates your acceptance of these terms and conditions.
  • All payment processing, including but not limited to the authorization, capture, settlement, and clearing of funds, will be conducted in accordance with the rules and regulations set forth by Maldives Islamic Bank’s payment gateway.
  • This Platform is not responsible for any issues arising from the use of Maldives Islamic Bank’s payment gateway, including but not limited to transaction processing failures, payment disputes, and transaction reversals. Users are advised to directly contact Maldives Islamic Bank for any concerns or issues related to payment gateway services.
  • Please be aware that Maldives Islamic Bank may modify its terms and conditions, and such changes may affect the payment services available on our marketplace. We encourage users to regularly review the payment gateway terms to stay informed about any updates.
  • This platform shall not be liable for any loss or damage arising from your failure to comply with the terms and conditions of Maldives Islamic Bank’s payment gateway.
  • Indemnity
  • You agree to indemnify, defend, and hold harmless Divashi.com, its parents, subsidiaries, affiliates, officers, directors, employees, agents, and suppliers (collectively the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees and court costs) that such parties may incur as a result of or arising from
    • any information (including, without limitation, your data, input, or any other content) you (or anyone using your account) submit, post, or transmit on or through the marketplace;
    • the use of the marketplace by you (or anyone using your account);
    • the violation of these Terms of Service by you (or anyone using your account); or
    • the infringement of any intellectual property or other rights of any person or entity by you (or anyone using your account).
  • Changes to the terms and conditions
  • Divashi.com reserves the right, at its sole discretion, to modify, alter, or otherwise update these Terms and Conditions at any time. By continuing to use our marketplace after changes are posted, you agree to be legally bound by the revised terms.
  • We will make reasonable efforts to notify users of significant changes to these Terms and Conditions. Such notifications may occur through various means, including, but not limited to, posting a notice on our website, sending an email to users, or another form of communication that Divashi.com deems appropriate.
  • Your continued use of the marketplace following the posting of changes to these Terms and Conditions constitutes your acceptance of those changes. If you do not agree to the amended terms, you should discontinue your use of the marketplace.
  • Governing laws
  • These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Republic of Maldives.
  • Any disputes that cannot be resolved through deliberation, will be resolved through the competent courts of the Republic of Maldives. You must agree to uphold and respect the decisions made by the competent courts of the Republic of Maldives.
